1. ACCEPTANCE OF TERMS (LEGALLY BINDING AGREEMENT)

By accessing our website, placing an order, or submitting any card(s) to The Mint Workshop Inc. (“Company,” “we,” “us”), you affirmatively agree to be bound by these Terms of Service (“Terms”).

If you do not agree, you must not use our Services.

Your use of our Services constitutes a legally binding agreement, including a valid electronic signature under the New Jersey Uniform Electronic Transactions Act and the federal Electronic Signatures in Global and National Commerce Act.


2. SERVICES PROVIDED

We provide cosmetic restoration and enhancement services for collectible trading cards, including but not limited to:

  • Surface cleaning and defect reduction
  • Edge and corner improvement
  • Crease and dent minimization
  • Flattening and de-warping
  • Cosmetic presentation improvements

We do not provide:

  • Grading
  • Authentication
  • Appraisals
  • Any guarantee of grading outcomes or value

We are not affiliated with any grading company or manufacturer.


3. CUSTOMER REPRESENTATIONS & DISCLOSURES

By submitting cards, you represent and warrant that:

  • You are the legal owner or authorized agent
  • The card is genuine to your knowledge
  • You have disclosed all known defects and prior alterations

You agree to disclose:

  • Prior restoration
  • Water or chemical exposure
  • Heat damage
  • Structural issues

Failure to disclose material information voids any claims against us.


4. DECLARED VALUE & LIABILITY CAP

You must provide a Declared Value for each card.

This value:

  • Must be accurate and in good faith
  • Is used for handling and insurance considerations
  • Sets the maximum liability cap

STRICT LIABILITY LIMITATION

To the fullest extent permitted by law:

👉 Our total liability is limited to the LESSER of:

  • The declared value of the card
  • The amount paid for the service

We are never liable for:

  • Market value changes
  • Grading outcomes
  • Lost profits or resale opportunities
  • Sentimental value
  • Indirect or consequential damages

5. RESTORATION RISKS & ASSUMPTION OF RISK

5.1 Irreversible Process

Restoration is experimental, subjective, and irreversible.

5.2 No Guarantees

We make no guarantees regarding:

  • Visual results
  • Structural outcomes
  • Defect removal
  • Grading or value

5.3 Hidden & Pre-Existing Issues

Cards may contain unseen defects that may:

  • Worsen
  • Become visible
  • React unpredictably

5.4 Potential Negative Outcomes

Restoration may result in:

  • New or worsened creases, bends, or warping
  • Surface defects (including pinholes, impressions, texture changes)
  • Gloss or print inconsistencies
  • Structural weakening
  • Reduced grading eligibility or value

5.5 Drying & Environmental Effects

Cards:

  • May not be fully dried upon return
  • May change over time due to environment
  • May shift, curve, or warp after delivery

We are not responsible for post-delivery changes.

5.6 Assumption of Risk

You explicitly:

  • Accept all risks
  • Agree results may be worse than original condition
  • Proceed entirely at your own risk

6. SHIPPING & RISK OF LOSS

We provide. a Fedex 2 day label. 

You may choose to use your own carrier.

You are responsible for:

  • Shipping method
  • Packaging
  • Insurance

We are not responsible for:

  • Incoming shipment damage or loss

Once returned to the carrier:
👉 Risk transfers to you.

Incoming shipments are insured up to a maximum of $500, as outlined in these Terms. This is standard industry practice and is similar to the shipping labels provided by major grading companies such as Professional Sports Authenticator (“PSA”). Insurance coverage for the full declared value applies only to outbound return shipments arranged by The Mint Workshop Inc.


7. CONDITION DOCUMENTATION & MEDIA USE

We may photograph or record cards for:

  • Documentation
  • Quality control
  • Evidence in disputes

You grant us a non-exclusive, royalty-free license to use anonymized images unless you opt out in writing before service.


8. TURNAROUND TIMES

All timelines are estimates only and not guaranteed.

Delays do not qualify for refunds or claims.


9. PRICING & PAYMENT

You agree to pay all fees, including:

  • Service costs
  • Shipping
  • Taxes

All payments are:
👉 Final and non-refundable once work begins


10. STRICT NO OUTCOME CLAIMS

You agree that dissatisfaction based on:

  • Appearance
  • Remaining defects
  • New defects
  • Grading results
  • Value changes

does NOT constitute service failure


11. DISCLAIMER OF WARRANTIES

All services are provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Expected results

12. LIMITATION OF LIABILITY (REINFORCED)

To the maximum extent permitted by law:

We are not liable for:

  • Any dissatisfaction with results
  • Any change in card condition
  • Any grading or resale outcome

Liability is strictly capped as outlined in Section 4.


13. CHARGEBACKS, FRAUD & DISPUTES

13.1 Agreement to Terms

By ordering, you confirm you:

  • Accepted all risks
  • Agreed to no refunds

13.2 Evidence Rights

We may submit:

  • Before/after photos
  • Work logs
  • Communications
  • These Terms

to dispute chargebacks.

13.3 Fraudulent Disputes

Chargebacks based on dissatisfaction may be treated as:
👉 bad-faith or fraudulent conduct

13.4 Recovery Rights

We may:

  • Recover funds
  • Charge fees
  • Deny future service

14. CONFIDENTIALITY & NON-DISPARAGEMENT

You agree not to:

  • Publish private communications
  • Make false or misleading statements

This does not restrict honest opinions, but prohibits knowingly false claims.


15. INDEMNIFICATION

You agree to indemnify and hold us harmless from claims arising from:

  • Your breach of Terms
  • Misrepresentation
  • Legal violations

16. TERMINATION

We may refuse or terminate service at any time.

You remain responsible for all incurred charges.


17. GOVERNING LAW & VENUE (NEW JERSEY)

These Terms are governed by the laws of the State of New Jersey.

All legal actions must be brought exclusively in New Jersey courts.


18. BINDING ARBITRATION & WAIVER OF RIGHTS

At our election, disputes may be resolved through binding arbitration in New Jersey.

You waive:

  • Jury trial rights
  • Class action participation

19. PREVAILING PARTY LEGAL FEES

The prevailing party in any dispute is entitled to recover:

  • Attorney’s fees
  • Costs and expenses

to the extent permitted under New Jersey law.


20. SEVERABILITY

If any provision is invalid, the remaining Terms remain enforceable.


21. CHANGES TO TERMS

We may update these Terms at any time.

Continued use = acceptance of updated Terms.


22. AFFIRMATIVE ACCEPTANCE (CRITICAL)

By placing an order or submitting cards, you:

  • Confirm you read and understood these Terms
  • Accept all risks
  • Agree to all limitations of liability
  • Agree services are non-refundable

You may not claim:

  • You did not read the Terms
  • You did not understand the risks

24. ADDITIONAL RESTORATION, SHIPPING & CONDITION DISCLOSURES

Customer acknowledges and agrees that collectible card restoration, conservation, alteration, flattening, moisture treatment, pressing, cleaning, and cosmetic enhancement are subjective and inherently risky processes.

The Mint Workshop Inc. makes no representations or guarantees regarding whether any restoration, alteration, conservation, repair, or prior work performed on a card will or will not be detected, identified, rejected, disclosed, or noted by any grading company, authentication company, marketplace, auction house, buyer, or other third party.

Customer further acknowledges that restoration services may constitute alteration, modification, conservation, or repair under standards or definitions used by certain grading companies, collectors, marketplaces, or third parties.

Submission of a card for restoration does not guarantee:

  • Any grading improvement
  • Any specific numerical grade
  • Any authentication outcome
  • Any increase in market value
  • Any increase in desirability or eye appeal
  • Eligibility for grading or encapsulation

Cards may contain latent, hidden, or pre-existing defects including but not limited to prior restoration, moisture exposure, structural weakness, compression damage, delamination, print instability, ink lifting, paper fatigue, trimming, recoloring, or chemical exposure. The Mint Workshop Inc. is not responsible for failures, damage, or adverse outcomes resulting from pre-existing conditions or material instability.

Inbound shipments are insured up to a maximum of $500 unless otherwise agreed in writing. This is standard industry practice similar to submission policies used by major grading companies including Professional Sports Authenticator (“PSA”). Insurance coverage for full declared value applies only to outbound return shipments arranged by The Mint Workshop Inc.

Customers are solely responsible for properly packaging submissions and for selecting desired inbound shipping insurance coverage. Improper packaging may void claims relating to transit damage.

The Mint Workshop Inc. is not responsible for cosmetic or incidental damage to sleeves, semi-rigid holders, toploaders, magnetic holders, binders, packaging materials, cases, or other accessories submitted with cards.

Our responsibility for outbound shipments ends upon carrier-confirmed delivery, including delivery scan, GPS confirmation, signature confirmation, or equivalent carrier proof of delivery.

Cards unpaid for or unclaimed for more than ninety (90) days after completion notice may be considered abandoned property. We reserve the right to charge storage fees, deny future service, or dispose of abandoned property in accordance with applicable law.

The Mint Workshop Inc. shall not be liable for delays, losses, or inability to perform services caused by events beyond our reasonable control, including but not limited to carrier delays, weather events, natural disasters, power outages, equipment failure, labor shortages, governmental actions, or third-party service interruptions.

These Terms constitute the entire agreement between the parties and supersede all prior or contemporaneous communications, representations, discussions, understandings, marketing statements, or agreements, whether oral or written.
