TERMS OF SERVICE

These Terms of Service ("Terms") govern all services provided by The Mint Workshop Inc. ("The Mint Workshop," "Company," "we," "our," or "us"). By submitting any collectible, trading card, or other property for service, placing an order, or using our website, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
1. Services
The Mint Workshop provides cosmetic restoration, conservation, cleaning, flattening, surface improvement, crease reduction, edge and corner improvement, and related enhancement services for collectible trading cards and similar items.
Our services are cosmetic in nature and are performed using professional judgment. Every item is unique, and results will vary.
We do not provide authentication, grading, appraisals, investment advice, or guarantees regarding future value.
2. No Guarantee of Results
Because restoration is subjective and irreversible, we make no guarantees regarding:

Visual appearance
-
Surface improvement
-
Structural integrity
-
Grading outcomes
-
Authentication
-
Market value
-
Future resale value
-
Eye appeal
Submitting an item acknowledges that restoration may improve, worsen, or have no noticeable effect on its appearance or grade.
3. Customer Representations
By submitting property, you represent and warrant that:

You are the lawful owner or have authority to submit the item.

The item is authentic to the best of your knowledge.

You have disclosed any known prior restoration, alterations, water damage, chemical exposure, trimming, recoloring, repairs, or structural issues.
Failure to disclose known defects may void any claim against The Mint Workshop.
4. Declared Value
Customers may be asked to provide a Declared Value for submitted items.
Declared Value is used solely for:

intake documentation;
-
handling procedures;
-
internal risk assessment;
-
determining shipping insurance when applicable; and
-
deciding whether we accept a submission.
Declared Value does not constitute an appraisal, guarantee of value, replacement value, purchase price, or admission of liability.
The Mint Workshop reserves the right to reject submissions with unreasonable or inaccurate declared values.
5. Restoration Risks
Customer acknowledges that restoration is an inherently risky and irreversible process.
Items may contain hidden defects or material instability that cannot be identified before treatment.
Possible outcomes include, but are not limited to:

additional creasing;
-
warping;
-
pinholes;
-
gloss changes;
-
print inconsistencies;
-
surface texture changes;
-
structural weakening;
-
visible prior repairs becoming apparent;
-
reduced grading eligibility;
-
reduced market value.
The Mint Workshop is not responsible for adverse results caused by hidden defects, prior restoration, manufacturing defects, age, deterioration, moisture damage, paper fatigue, or any other pre-existing condition.
6. Shipping & Risk of Loss
Customers are responsible for properly packaging all submissions.
Inbound shipments remain the customer's responsibility until physically received and documented by The Mint Workshop.
Inbound shipping labels provided by The Mint Workshop include insurance only as expressly stated at the time of purchase. Customers are responsible for obtaining additional insurance if desired.
Upon acceptance of an outbound shipment by the shipping carrier, title and risk of loss immediately transfer to the customer.
The Mint Workshop is not responsible for carrier delays, theft, weather events, misdelivery, or shipping losses occurring after carrier acceptance.
7. Limitation of Liability
To the fullest extent permitted by applicable law, if The Mint Workshop is found legally responsible for loss of or physical damage to submitted property while it is in our possession, our maximum liability shall be limited to the current fair market value of the item immediately prior to the loss or damage, regardless of any declared value, purchase price, appraisal, insurance value, sentimental value, or estimated future value.
Declared Value does not establish, increase, or determine the amount of compensation owed.
In no event shall our liability exceed the item's objectively determined current fair market value.
8. Fair Market Value
Current Fair Market Value shall be determined using commercially reasonable methods, including consideration of:

actual condition;
-
authenticity;
-
grading status;
-
restoration history;
-
recent completed public sales;
-
recognized auction results; and
-
established collectible marketplaces.
Examples include completed sales from eBay, TCGplayer, Goldin, Heritage Auctions, PWCC, COMC, and similar recognized marketplaces.
Listing prices, asking prices, price guides, speculative values, insurance schedules, replacement cost, emotional attachment, or projected appreciation shall not determine Fair Market Value.
9. Exclusive Remedy
If compensation is owed, The Mint Workshop may, at its sole discretion:

repair the item;
-
complete restoration;
-
provide partial compensation;
-
provide monetary compensation equal to the determined Fair Market Value; or
-
replace the item with a substantially comparable item if reasonably available.
The Company is not obligated to purchase an identical replacement.
Monetary compensation under these Terms shall constitute the customer's exclusive remedy.
10. Disclaimer of Damages
To the fullest extent permitted by law, The Mint Workshop shall not be liable for:

grading results;
-
resale value;
-
investment losses;
-
market fluctuations;
-
future appreciation;
-
lost profits;
-
business interruption;
-
consequential damages;
-
incidental damages;
-
punitive damages;
-
emotional distress;
-
sentimental value.
11. Payment & Refunds
All restoration fees become non-refundable once work has begun.
Orders canceled before work begins may be subject to administrative or shipping charges.
12. Turnaround Times
Estimated turnaround times are estimates only.
Delays caused by workload, staffing, equipment, shipping carriers, weather, or circumstances beyond our control do not constitute breach of contract and are not grounds for refunds.
13. Photography & Documentation
The Mint Workshop may photograph, scan, or record submitted items for documentation, quality control, insurance, dispute resolution, and promotional purposes.
Customers may request exclusion from promotional use by notifying us in writing before service begins.
14. Abandoned Property
Completed orders remaining unpaid or unclaimed for more than ninety (90) days after notification may be considered abandoned.
The Mint Workshop reserves the right to charge storage fees, refuse future service, or dispose of abandoned property in accordance with applicable law.
15. Chargebacks & Payment Disputes
Customers agree not to initiate chargebacks or payment disputes for services performed in accordance with these Terms.
The Mint Workshop reserves all legal rights to dispute improper chargebacks and recover associated fees, costs, collection expenses, and attorney's fees where permitted by law.
16. Force Majeure
The Mint Workshop shall not be liable for delays or inability to perform services resulting from circumstances beyond our reasonable control, including natural disasters, severe weather, carrier interruptions, equipment failure, labor shortages, utility failures, governmental actions, or other unforeseen events.
17. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of New Jersey without regard to conflict-of-law principles.
Any legal action shall be brought exclusively in the state or federal courts located in New Jersey unless otherwise required by applicable law.
18. Arbitration
Where permitted by law, The Mint Workshop may elect to resolve disputes through binding arbitration conducted in New Jersey.
Customer waives any right to participate in a class action or class arbitration to the fullest extent permitted by law.
19. Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms constitute the complete agreement between the customer and The Mint Workshop and supersede all prior discussions, representations, marketing materials, and understandings relating to the services provided.
21. Acceptance
By placing an order, submitting property, or using our services, you acknowledge that you have read, understood, and agree to these Terms of Service, including the limitations of liability contained herein.
